TRENTON, N.J. — The Third Circuit on Tuesday granted New Jersey’s motion to stay its mandate in ANJRPC v. Platkin, putting its July 17 decision that struck down the state’s “assault weapons” and magazine ban on hold while New Jersey seeks review at the U.S. Supreme Court. In a companion order issued the same day, the court formally stayed the consolidated cases and directed all parties to file a status report by September 3, 2026, and every 30 days thereafter until the stay is lifted.
The practical effect: New Jersey’s ban remains in effect for now. The stay holds pending the Supreme Court’s disposition of the state’s anticipated petition for a writ of certiorari, and if the justices agree to hear the case, it will stay in place through their final decision on the merits.
