An Instagram guy says he “supports the Second Amendment” because he “read the whole thing” — and then immediately runs into the same tired well regulated militia argument that has already been answered by history, the text itself, and the Supreme Court in Heller. In this video, I break down the claim that the Second Amendment only protects some kind of government-controlled militia, why that reading falls apart once you understand the difference between the prefatory clause and the operative clause, and why the phrase “the people” means exactly what it means everywhere else in the Bill of Rights. I also get into Justice Scalia’s Heller opinion, the Militia Act of 1792, and why anti-gun arguments that cite early American history usually end up proving the opposite of what they intended. I also walk through the founding-era sources people keep pretending do not exist, including George Mason, Richard Henry Lee, Federalist 29, and the 18th-century meaning of “well regulated.” That phrase did not mean government restriction in the modern anti-gun sense. It meant properly functioning, properly armed, organized, and trained. That matters, because the whole modern argument depends on pretending those words meant something they did not. The video also addresses the common anti-2A talking points about concealed carry bans in Kentucky and Tennessee, the misuse of historical examples like Bliss v. Commonwealth and Andrews v. State, and the claim that only the gun industry profits from absolutist Second Amendment arguments while ignoring the massive amount of money flowing through the modern gun control lobby, including groups backed by Michael Bloomberg, Everytown, and others.
