During his State of the Union address last night, President Biden used his platform to renew a call for a ban on so-called “assault weapons”.
Three important New Jersey cases involving mag bans and so-called “assault weapons” were consolidated in front of a single federal judge yesterday. 2nd Amendment proponents are generally not in favor of this consolidation as the cases are not really similar enough to be considered the “same” issue. Will the consolidation last?
Murphy and Platkin had better get used to losing. A recently enacted law, designed to allow the State to circumvent PLCAA and bankrupt the gun industry, just had a Preliminary Injunction issued against it. Allowing these kinds of lawsuits would almost certainly make firearms more difficult to obtain and much more expensive. The icing on the cake here is that the federal judge is a Biden appointee.
Its only January and the victories keep rolling in. 2023 is going to be a good year for the 2nd Amendment in New Jersey. Today’s TRO in the Siegel v. Platkin case expands upon the original Carry Killer TRO issued in the Koons v. Reynolds case a short time ago. This train’s next stop will be the preliminary injunction phase which may result in even further invalidation of the new law.
In a disappointing bit of news, the US Supreme Court denied certiorari in the case of Greco v. Platkin, which challenges New Jersey’s so-called Red Flag laws. Despite all parties agreeing that the law is unconstitutional, the inferior courts have also dismissed the case. New Jerseyans will need to stay on their neighbors’ good sides for the time being.
